What are the current trends in compliance and ADA enforcement?

How can DMU balance compliance and risk management approaches in policy and practice?

Now that the Americans with Disabilities Act Amendments Act (ADAAA) has reduced denials based on not qualifying for protection, more cases are focusing on the “reasonableness” of the accommodation. Fundamental alteration is the most important aspect of “reasonable” in an academic context. Can DMU define fundamental alteration and do we have a process to document it?  Explore recent and significant decisions made by the courts and Departments of Justice and Education on access to higher education.

Two expert presenters will highlight and explore decisions and settlements made across a range of areas including:

  • Web based services and instruction
  • Testing accommodations
  •  Services and support animals
  • Documentation
  • Housing implications for policy development and implementation

  • Identify current trends in compliance and ADA enforcement.
  • Recognize areas in need of policy development.
  • Define fundamental alteration and a process used to document it.
  • Identify five resources on compliance trends.
  • Determine an appropriate approach to Web Access on campus.
  • Balance compliance and risk management approaches in policy and practice.
  • Assess the particular problems attendant to Autism, Asperger’s syndrome and Learning Disabilities.
